ADDITIONAL DRIVERS - All drivers must be at least 21 years of age and present a valid photo drivers license. If you are under the age of 25 there is a young driver fee of $20/day + tax.


All policies that apply to the primary driver will also apply to the additional drivers.


The first driver is included and any additional driver is $5/per trip, plus tax. There is a maximum of 4 drivers allowed per reservation.


AGE - Renter must be 21 years of age with a valid driver's license and major credit card in his/her own name. 


PAYMENT RULES - You may book on our website and pay with any major credit card. If you're using a foreign credit card you may need to call your issuing bank or credit card customer service to approve the charge before it will successfully process.


We require a $250 damage deposit. It is refunded after you return the vehicle with no damage or excessive wear and tear (example: ripped tires). Payment for the damage deposit and rental itself is due in full at the time of booking to secure your reservation. If you book online and do not pay then the vehicle you selected will still be available for anyone else to rent over your rental dates.


If you cannot provide documentation showing Full Comprehensive & Collision Coverage and $100k Bodily Injury Liability Coverage you have 2 options. You can increase your coverage temporarily over your rental dates or use our insurance coverage. If you use our coverage there is a $20/day processing fee, plus tax, and an additional $250 refundable damage deposit. This brings the total refundable damage deposit to $500. Our insurance has a $1,000 deductible for liability and a $1,000 deductible for property damage.


To honor the reservation, all prices are final after booking. We don't allow further discounts after the rental reservation is made. There is a $100 cancellation fee and $50 rebooking fee for shortening your trip. If you cancel your reservation at least 3 days in advance of its scheduled start time you will receive a full refund less the $100 cancellation fee. If you cancel less than 3 days in advance we cannot guarantee a refund, but we will refund you depending upon the same vehicle booking over your cancelled rental period. There is no fee for adjusting dates and keeping the trip length the same as long as it's requested at least 3 days in advance. 


DRIVERS LICENSE - Drivers must have a valid driver’s license at the time of rental. The driver’s license must be valid for the entire rental period. International renters require a driver’s license with photo ID on it from your home country of residence.


EARLY RETURN - Vehicles are rented on a daily (24 hour) basis. Any rental of less than 24 hours will be charged a full day’s rate. 


EQUIPMENT - Available Equipment: Child Booster Seat, Beach Umbrella, Tommy Bahama Beach Chair/backpack/cooler combo, Boogie Board, & 30 Quart Cooler.


FUEL - Prepay Fuel Option (Buy a Tank) $150 for all vehicles excluding *Grand Cherokee. The Grand Cherokee is $175.


Vehicle is rented with a full tank. You may purchase a full tank of fuel at the time of rental and return the rental with fuel at any level. There will be no credit issued for unused fuel.


Fuel Service Option (We Fill the Tank)


Vehicle is rented with a full tank. You may return the rental full to avoid a charge or we will refuel the vehicle based on the level of the tank. A refueling service fee of $20 will be charged.


INSURANCE - We require documentation of auto insurance that will cover your rental vehicle with Full Comprehensive & Collision Coverage and $100k Bodily Injury Liability Coverage. All of the information we need can be found on your Declaration Page or renewal documents. The document must show the name of insured drivers, effective dates over your rental period, insurance company name and the policy number.


If you do not meet the minimum insurance requirements you can increase your coverage temporarily over your rental dates or use our insurance coverage. If you use our coverage there is a:


Daily Processing Fee $30/day plus tax and $250 Damage Deposit Required. Includes $2,000 deductible for liability coverage and $2,000 deductible for vehicle damage.


Daily Processing Fee $50/day plus tax and $250 Damage Deposit Required. Includes $500 deductible for liability coverage and $500 deductible for vehicle damage.


MILEAGE - Rate comes with unlimited mileage per trip.


OVERSTAY - If the vehicle is not returned on the date and time agreed upon at the time of reservation, all special rates will be charged at the regular rate with an additional late penalty. You must contact us immediately if there's any issues with returning the vehicle to us on the agreed upon date, time and location. Generally we are booked back to back and cannot accommodate late checkouts, new locations or last minute extensions. If we can accommodate you we will, but we will never allow a current guest to interfere with the next reserved guests booking.


If you do not respond to us in email, phone or text and do not show up to return the vehicle as agreed we will report it as stolen to the police, track it down and pick it up.


CANCELLATION & ADJUSTING TRIPS - To honor the reservation, all prices are final after booking. We don't allow further discounts after the rental reservation is made. There is a $100 cancellation fee and $50 rebooking fee for shortening your trip. If you cancel your reservation at least 3 days (72 hours) in advance of its scheduled start time you will receive a full refund less the $100 cancellation fee. If you cancel less than 3 days (72 hours) in advance we cannot guarantee a refund, but we will refund you depending upon the same vehicle booking over your cancelled rental period. There is no fee for adjusting dates and keeping the trip length the same as long as it's requested at least 3 days in advance. 


RESERVATION HOLD TIME - If you have a change in travel plans and cannot make it to your scheduled vehicle pick up time and location please contact us ASAP. You may call, text or email us to advise of any changes. We will hold the vehicle for you for 4 hours. If we still haven't heard from you 3 hours after your scheduled trip start time then you will be considered a no-show and we may not be able to honor your reservation if we have other guests waiting for a vehicle. You may also provide us with your flight information so we can track if your flight is running late, rescheduled, etc. If we have your flight information and this is causing your delay then we will hold your vehicle until you arrive. We understand that while in flight to Hawai'i communication is limited.


PETS - Absolutely no non-human creatures or pets are permitted in our rental vehicles.


SMOKING - All vehicles are non-smoking. If smoking residue, debris or scent is left in the vehicle when you return it you will be charged a significant cleaning fee based on the time, effort, and resources required to remedy the vehicle to its original condition. Do not smoke anything in the vehicle!

Hawai’i Lifted Jeep Rentals (“we”, “us” or “our”) developed this service to make it easy for you to make use of cloud-based auto rental management software online as well as make payments or receive payments online by credit cards, so you can focus on your own product or service. We understand that privacy is important to both our online visitors and registered users. We respect your privacy and will take reasonable steps to protect your information.

4. Checkout Users

When you use Hawai’i Lifted Jeep Rentals Checkout on a merchant’s website to store your payment credentials, we will gather and store your payment card information, your email address, your mobile phone number, and billing and shipping address. Rental/Loaner Terms and Conditions

RENTAL/LOANER AGREEMENT TERMS AND CONDITIONS


1. DEFINITIONS.

“Agreement" means all terms and conditions found on both sides of-this form: "You'" or "Your'' means the person or organization identified as the renter on the reverse side of this Agreement, any person signing this Agreement, any Authorized Driver, and any person or organization to whom charges are billed by Us at its or the customer’s direction. All persons referred to as "You” or “Your" are jointly and severally bound by this Agreement. "We", “Our" or "Us" means the business named on the reverse side of this Agreement. "Authorized Driver" means You and any additional driver approved and listed by Us on this Agreement, PROVIDED THAT you and each additional driver are at least 21 years old (unless otherwise agreed to by Us in writing} and possess a valid driver's license. "Vehicle" means the automobile or truck identified in this Agreement and any substitute vehicle We provide, and all its tires, tools, accessories, equipment, keys and documents. "CCDW" means Comprehensive and Collision Damage Waiver. “Collision Damage" means damage to the Vehicle caused by collision or upset. "Comprehensive Damage” means damage to, or loss of, the Vehicle caused by theft or vandalism by anyone other than You Or Your passengers; damage caused by an act of nature, riot or civil disturbance, and fire; but, does not include damage caused by animal transported in the Vehicle. “Loss of Use" means the amount calculated by multiplying the number of days from the date of damage to the Vehicle until it is repaired times the daily rental rate shown on the reverse side of this Agreement.


2. RENTAL OR LOANER; REPOSSESSION; INDEMNITY AND WARRANTIES.

If You are obligated to pay Us a time or mileage fee for use of the Vehicle, this Agreement is a contract for rental of the Vehicle. If You are not obligated to pay us a time or mileage fee for use of the vehicle, this Agreement is a contract for loan of the Vehicle only. We may repossess the Vehicle at Your expense without notice to You, if the Vehicle is abandoned or used in violation of law Or this Agreement. You waive any right to a hearing or to receive notice of legal process as a pre-condition to Our repossession of the Vehicle. You agree to indemnify Us, defend Us and hold Us harmless from all claims, liability, costs and attorney fees We incur resulting from, or arising out of, this transaction including Your use of the Vehicle. We make no warranties, express, implied or apparent, regarding the Vehicle, no warranty of merchantability and no warranty that the Vehicle is fit for a particular purpose.


3. CONDITION AND.RETURN OF VEHICLE.

You must return the Vehicle to Our office or other location We specify, on the date and time specified in this Agreement, and in the same condition that You received it, except for ordinary wear. Service to the Vehicle or replacement of parts or accessories must have Our prior approval.


4a. RESPONSIBILITY FOR VEHICLE DAMAGE OR LOSS; REPORTING TO POLICE.

Except for ordinary wear, You are responsible for all damage to, or loss of, the Vehicle, Loss of Use, diminished value of the Vehicle caused by damage to it or repair of it, missing equipment, and a reasonable charge to cover Our administrative expenses incurred processing any damage claim, whether or not You are at fault. You must report all accidents or incidents of theft and vandalism to Us and the police as soon as You discover them.

4b. INSURANCE AND LULA COMMERCIAL AUTO INSURANCE: You have the option of either, (i) providing Us with proof of comprehensive automobile insurance that would cover damage to the Vehicle up to $50,000.00 to cover Comprehensive/ Collision Damage, and $100,000.00 to cover bodily injury and liability per incident, or (ii) paying an increased Security Deposit (as defined in Section 7 below) of $500.00 instead of $250.00, plus an additional processing fee of $20.00 per day plus applicable taxes. If the Vehicle is damaged or destroyed while it is in Your possession, You agree to pay any required insurance deductible and further agree to assign all rights to collect insurance proceeds to Us. Lula Commercial Auto Insurance (“LULA”) is included with your rental, which includes Automobile Liability coverage with a $1,000.00 deductible, and Physical Damage (Comprehensive/Collision Damage coverage) with a $1,000.00 deductible. You understand and agree that You are responsible for paying the LULA deductible on any claim. The deductibles are payable directly to us. You further understand that LULA coverage is secondary to your automobile insurance coverage and that We will be named as an additional insured under all LULA policies purchased. A spare tire and tools are provided in Your rental. LULA coverage DOES NOT cover lost key replacements. Lost or stolen keys will result in a charge of $100.00 for non-transponder keys or $430 for transponder chip/programmable keys.


5. PROHIBITED USES.

The following acts are prohibited uses of the Vehicle and breaches of this Agreement: The Vehicle may not be used (a) by anyone who is not an Authorized Driver, or by anyone whose driving license is suspended in any jurisdiction; (b) by anyone under the Influence of legal or illegal drugs, or alcohol; (c) by anyone who obtained the Vehicle or extended the rental or Ioan period by giving Us false, fraudulent or misleading information; (d) for any illegal purpose or under any circumstance that would constitute a violation of law other than a minor traffic violation; (8) to carry persons for hire; (f) off road, off the Big Island of Hawai’i, or to push or tow anything, without Our written consent; (g) In any race, speed test or contest; (h) to teach anyone to drive; (i) to carry dangerous or hazardous Items or illegal material; (j) when loaded beyond its capacity as determined by the manufacturer of the Vehicle; (k) to transport more persons than the Vehicle has seat belts, or to carry persons outside the passenger compartment; (I) to transport children without approved child safety seats as required by law; (m) when the odometer has been tampered with or disconnected; (n) to drive through or under an overpass or other structure without sufficient overhead or side clearance; (o) when It is reasonable to expect You to know that further operation would damage the Vehicle; (p) when cargo is inadequately secured; (q), where applicable, by anyone who lacks experience operating a manual transmission; and, (r) for any law enforcement use or law enforcement related activity. You are also prohibited from committing a willful, wanton or reckless act with the Vehicle, from sub-renting or sub-leasing the Vehicle, or failing to summon the police to any accident involving personal Injury or property damage.


6. INSURANCE, COVID, & QUESTIONNAIRE.

You are responsible for all damage or loss You cause to others or their property as well as the rental vehicle itself. You agree to provide auto liability of at least $100k, full comprehensive and collision insurance covering You, Us, and the Vehicle. All drivers must provide documentation confirming their insurance coverage for the period of their rental and complete the customer questionnaire. All drivers on the rental policy must also submit their Covid documentation (vaccine card or negative pre-travel test) that is approved by the State of Hawaii to avoid a mandatory quarantine.


7a. CHARGES.

You agree to pay Us, or any appropriate government authority, on demand for all charges due Us under this Agreement, including, but not limited to: (a) time and mileage during the period of the rental, or a mileage charged based on Our experience if the odometer is tampered with or disconnected; (b) charges for additional drivers: (c) charges for the optional products and services You elected to purchase; (d) fuel; if You return the Vehicle with less fuel than when rented or loaned; (e) applicable taxes; (f) the actual cash value of the Vehicle on the date of the loss, if the Vehicle is lost, stolen or totaled; (g) if the Vehicle is damaged, You agree to pay Us the cost of repairs if We elect to repair the Vehicle, or the difference between the value of the Vehicle at the time of rental or loan and the actual cash value of the Vehicle after it is damaged, if We elect not to repair the Vehicle; (h) Loss of Use and Our administrative fees incurred in processing a claim for loss or damage; (i) all traffic, parking and toll violations, fines, penalties, forfeitures, court costs, towing charges and other expenses involving the Vehicle assessed against Us or the Vehicle, unless these expenses are Our fault; (j) expenses We incur in locating and recovering the Vehicle if You fail to return it or if We elect to repossess it under the terms of this Agreement; (k) all costs, including pre- and post-judgment attorney fees, We incur collecting payment from You or otherwise enforcing Our rights under this Agreement; (I) a 2% per month late payment fee, or the maximum allowed by law (if less than 2%) on all amounts past due; (m) 1 ½% per month interest, or the maximum allowed by law (if less than 1½%) on monies due Us but not paid upon return of the Vehicle; (n) $50, plus $10/mile for every mile between Our office and the place where the Vehicle ls returned or abandoned, plus any additional recovery expenses We incur; (o) $25 or the maximum permitted by law, whichever is greater if You pay Us with a check returned unpaid for any reason; and (p) a reasonable fee not to exceed $150 to clean the vehicle, if returned substantially less clean than when rented or loaned; (q) if smoked in a cleaning fee of $200. Lost/Damaged Keys will incur a $415 Replacement Fee


7b. SECURITY DEPOSIT: You will provide a security deposit to Us in the amount of, (i) $250.00 if you provide valid automobile insurance as specified in Section 4 above, or (ii) $500.00 if you do not provide valid automobile insurance as specified in Section 4 above (the “Security Deposit”), to be used by Us in the event of loss or damage to the Vehicle. In the event of damage to the Vehicle, We will apply the Security Deposit to defray the costs of necessary repairs or replacement, or to pay the LULA deductibles (as provided in Section 4). If the cost for repair or replacement of damage to the Vehicle (or the cost of the LULA deductible) exceeds the amount of the Security Deposit, You will be responsible for payment of the balance of the cost of any and all repairs or replacements.


8. DEPOSIT.

We may use Your deposit to pay any amounts owed to Us under this Agreement.


9. YOUR PROPERTY.

You release Us, Our agents and employees from all claims for loss of, or damage to, Your personal property or that of any other person that We received, handled or stored, or that was left or carried in or on the Vehicle or in any service vehicle or in Our offices, whether or not the loss or damage was caused by Our negligence or was otherwise Our responsibility.


10. BREACH OF AGREEMENT.

You waive all recourse against Us for any criminal reports or prosecutions that We take against You that arise out of Your breach of this Agreement.


11. MODIFICATIONS.

No term of this Agreement can be waived or modified except by a writing that We have signed. If You wish to extend the rental or loan period, You must obtain written authorization from Us on or before the date due, provided that the total rental or loan period does not exceed 30 days. This Agreement constitutes the entire agreement between You and Us. All prior representations and agreements between You and Us regarding this transaction, whether verbal or written, are merged into this Agreement. If you wish to add driver(s) this must be approved by us beforehand. We require a picture of the driver's license, for them to complete a customer questionnaire, provide Covid documentation and provide insurance documentation.


12. MISCELLANEOUS.

No waiver by Us of any breach of this Agreement constitutes a waiver of any additional breach or waiver of the performance of Your obligations under this Agreement. Our acceptance of payment from You or Our failure, refusal or neglect to exercise any of Our rights under this Agreement does not constitute a waiver of any other provision of this Agreement. You release Us from any liability for consequential, special or punitive damages in connection with this transaction or the reservation of a vehicle. If any provision of this Agreement is deemed void or unenforceable, the remaining provisions are valid and enforceable.
